An e-cigarette is an electronic device that simulates tobacco smoking. E-cigarettes are hand held battery powered vaporizers. Using an e-cigarette is called “vaping.” In 2016, the Surgeon General’s Report on e-cigarettes noted startling statistics that more than 3 million youth in middle and high school, including 1 in 6 high school students, had used e-cigarettes in the past month. More than 85 % of e-cigarette users age 12-17 use flavored e-cigarettes, and 80% of the use is with JUUL products. JUUL is an e-cigarette company which packages nicotine salts from leaf tobacco into one-time use cartridges. JUUL became the most popular e-cigarette in the United States at the end of 2017. Its widespread use by youth has triggered concern from the public health community and multiple investigations by the U.S. Food and Drug Administration. Given the high nicotine concentrations in JUUL, there is concern that the nicotine-related health consequences of its use by young people could be more severe than those from their use of other e-cigarette products. JUUL actually marketed its products to teens and young adults to switch to e-cigarettes or “vaping” devices as a way of breaking an addiction to traditional cigarettes. Others were persuaded to switch to JUUL because the nicotine was flavored. JUUL marketed the products as safer than traditional cigarettes and that vaping was safe and non-addictive. Currently, there are numerous lawsuits against JUUL claiming that JUUL use led to nicotine addiction, despite no mention of risk from the company, and that the amount of nicotine delivered into the bloodstream by the device is not clearly stated. In addition, these lawsuits claim that JUUL’s advertising targeted teens under the legal smoking age and that there were inadequate safety measures to ensure preventing underage smokers of JUUL and e-cigarettes.
