Students’ Civil Rights to be Protected from Sexual Abuse at Schools Diminished under New Title 9 Rules

The Trump administration diminished the rights of sex abuse victims under new Title 9 rules for college students – reversing prior civil rights standards for students established by the Obama administration.
Namely, a Victim’s right to presumption of truth was deleted and the school can now opt, at its own discretion, to require “clear and convincing evidence (substantially greater than 50%)” rather than prior standard of “preponderance of the evidence (i.e. 50%).” Rights were also diminished for minority and marginalized students who also suffer discrimination within the culture of a school.
