Minor-Child suffered catastrophic Hypoxic Ischemic Encephalopathy and Cerebral Palsy due to Birth Trauma.
This matter handled by John W. Baldante, Esquire involved a birth trauma during delivery to a full term newborn. It was alleged that the defendant obstetrician acted negligently isn delaying the delivery of the plaintiff newborn. The baby’s external monitor fetal heart tracing revealed evidence of diminished oxygen to the fetus during labor compelling an emergency caesarian section, but the defendant doctor failed to respond to this ominous tracing causing the then unborn fetus to suffer for approximately 39 minutes without adequate oxygen.
The plaintiff newborn suffered a severe brain injury and lived with Cerebral Palsy (CP) for over four years before passing away due to respiratory difficulties associated with his CP. After litigating the case for 2½ weeks, the Jury returned a verdict for $4.5 Million in favor the deceased child and his surviving parents.
