The action involved a driver who collided his vehicle with the defendant driver’s vehicle. The 82-year-old decedent driver made a left turn in front of the defendant. The elderly driver then suffered an initial non-displaced cervical fracture, which led to a hospitalization.
During the treatment, several complications took place, which led to a myocardial infarct, the development of a MSRA infection and a congestive heart failure. The patient had to then be intubated due to the development of a respiratory distress.
Several other complications were reported and made evident during the trial. Family members stated that prior to the accident, the 82-year-old was an active and a “vibrant individual” who was joyful about living life and had no major health issues.
It has been established that the patient suffered great pain and suffering as a result of the significant complications.
The wrongful death case involving the 82-year-old was settled for $1,125,000.
